Sonali Badhe vs. Ashish Singh and Others Delhi High Court (2015)

Sonali Badhe had filed a complaint against Mr. Ashish Singh in the internal complaint committee, the committee recommended that Mr. Ashish Singh is liable for the Sexual Harassment and is responsible to bear monetary compensation of Rs.10,000 but the final report was not submitted to the Employer to accelerate actions and before the submission, Ashish Singh appealed in the court. The High Court held that the appeal was pre-mature and he cannot file any appeal before the submission of final report to the disciplinary authority by the ICC. The Court provided two weeks’ time to make a representation before the ICC. The ICC will pass final order within four weeks and submit it to the disciplinary Authority only after that the respondent shall be able to file an appeal.
